Accesibilidad electoral: el sufragio activo con perspectiva de derechos humanos

Abstract

En el año 2023, la República Argentina conmemoró cuarenta años ininterrumpidos de democracia, sin embargo, pareciera que algunos ciudadanos aún siguen siendo invisibles o, peor aún, visibles, pero insignificantes, a la hora de adoptar políticas públicas e impartir justicia. Este trabajo es una invitación a la reflexión y pretende interpelar a los profesionales del derecho para que, independientemente del rol que ocupen en la sociedad, cuenten con herramientas para analizar críticamente la realidad y así sean capaces de transformarla.Destacando la importancia del derecho electoral en una sociedad democrática y contemplando la diversidad como característica intrínseca de la humanidad, analizaremos, desde la perspectiva de derechos humanos, la importancia de la accesibilidad electoral en el derecho de sufragio activo basándonos en el respeto irrestricto de la dignidad de las personas. La necesidad de que los abogados reflexionemos sobre las implicancias de nuestro accionar no es algo novedoso. Pero ser abogado es un privilegio y un honor, por ello, espero que las próximas páginas humildemente contribuyan a que los hombres y mujeres del derecho hagamos un cambio, más que jurídico, de corazón.

In 2023, the Argentine Republic commemorated forty uninterrupted years of democracy, however, it seems that some citizens still remain invisible or, worse still, visible, but insignificant, when it comes to adopting public policies and dispensing justice. This work is an invitation to reflection and aims to challenge legal professionals so that, regardless of the role they occupy in society, they have tools to critically analyze reality and thus be able to transform it. Highlighting the importance of the electoral right in a democratic society and considering diversity as an intrinsic characteristic of humanity, we will analyze, from the perspective of human rights, the im-portance of electoral accessibility in the right to active suffrage based on unrestricted respect for dignity of the people. The need for lawyers to reflect on the implications of our actions is not something new. But being a lawyer is a privilege and an honor, therefore, I hope that the next pages humbly contribute to the men and women of law making a change, more than legal, from the heart.
