¿Qué elegimos cuando votamos? Apuntes sobre la normativa electoral nacional y su relación con la legitimidad de la representación política

Abstract

La estructura legal de la representación política en el orden nacional argentino propone un escenario especialmente complejo, volviendo difícil un análisis nítido de su entramado. Enfocándonos en dicho andamiaje, podemos destacar, a título ilustrativo, piezas fundamentales como los partidos políticos y sus afiliados/as, las categorías electorales en disputa, postulantes, plataformas ideológicas y la ciudadanía. Pero es a partir del específico reconocimiento jurídico que posee cada uno de dichos elementos que se configura el régimen de gobierno representativo en nuestro Estado, el cual es, asimismo, reflejo de cómo interactúan tales actores e instrumentos entre sí. En ese sentido, la búsqueda del presente artículo tiene como objetivo identificar ciertas tensiones que surgen a partir del examen del plexo normativo electoral, las cuales, al tiempo que delinean, contienen y delimitan la existencia jurídico-política entre las relaciones políticas, acechan la legitimidad política, distanciando jurídicamente a la ciudadanía de sus representantes.

The legal structure of political representation in Argentine’s national order proposes a particularly complex scenario, hindering a clear analysis of its framework. Focusing on this scaffolding, we can highlight, for illustrative purposes, fundamental pieces such as political parties and their affiliates, electoral categories in dispute, applicants, ideological platforms and voters. But it’s from the specific legal recognition that each of these elements has that the representative government regime in our State is configured, which is also a reflection of how such actors and instruments interact with each other. Considering that, the research of this article aims to identify certain tensions that arise from the examination of the electoral normative plexus, which while delineating, containing and delimiting the legal- political existence between political relations, they threaten political legitimacy by legally distancing citizens from their representatives.
