Abstract

La legitimidad del sistema de resolución de controversias del deporte federado internacional –como repuesta a la pregunta de cuál es la fuente jurídica que autoriza a la emisión y ejecución de los laudos del Tribunal Arbitral del Deporte ante los sistemas estatales– es analizada desde la representación “trasnacional” propuesta por E. Gaillard en el ámbito del arbitraje comercial internacional con ciertas adecuaciones que describen las circunstancias que según cada caso atenúan o fortalecen la legitimidad del sistema. Se concluye que el método trasnacional sería un gran aporte en la construcción y robustecimiento de la referida legitimidad.

The legitimacy of the international federated sport dispute resolution system – as a response to the question of which is the legal source that authorizes the issuance and execution of the awards of the Court of Arbitration for Sport before state systems – is analyzed from the “transnational” representation proposed by E. Gaillard in the field of international commercial arbitration with certain adjustments that describe the circumstances that, depending on each case, mitigate or strengthen the legitimacy of the system. It is concluded that the transnational method would be a great contribution in the construction and strengthening of the aforementioned legitimacy.
