El derecho a la paz ambiental frente al desafío de la discriminación: el caso "Lhaka Honhat (nuestra tierra) contra Argentina"

Abstract

En el presente artículo se analizan las implicancias de considerar al medio ambiente sano como elemento constitutivo para el derecho humano a la paz y, frente a ello, los retos que individuos y Estados deben asumir ante los actos discriminatorios contra el ambiente. Para ello, se recurre a la revisión de un reciente caso emitido por Corte Interamericana de Derechos Humanos durante el año 2020, con el objetivo de vislumbrar la relación que existe entre el derecho a un medio ambiente sano y el derecho a la paz. Además, se pretende hacer hincapié en las acciones presentes y futuras que ofrezcan la posibilidad de contrarrestar todo acto que atente contra estos derechos de manera indiscriminada y para el provecho particular.

This article analyzes the implications of considering a healthy environment as a constitutive element for the human right to peace and, in view of this, the challenges that individuals and States must assume in the face of discriminatory acts against the environment. To do this, the review of a recent case issued by the Inter-american Court of Human Rights during the year 2020 is used, with the aim of identifying the relationship that exists between the right to a healthy environment and the right to peace. In addition, emphasis is made on present and future actions that offer the possibility of counteracting any act that violates these rights in an indiscriminate manner and for a private benefit.
