Dignidad de la ley e interpretación jurídica en Jeremy Waldron

Abstract

Con este trabajo buscamos indagar, por un lado, cuál es la teoría de la interpretación jurídica de Jeremy Waldron y, por el otro, si existe una relación entre esta última y su teoría normativa sobre las fuentes del derecho. En concreto, nos preguntamos si existe alguna relación entre la tesis de las fuentes sociales defendida por el positivismo normativo de Waldron (tesis de la especial dignidad/autoridad de la legislación democrática) y su teoría de la interpretación jurídica (¿tesis textualista o de la integridad?). La lección que esperamos aprender de este análisis es que si se pretende hacer una teoría normativa del derecho, no es posible independizar completamente el aspecto estático del derecho (en este caso, teoría de las fuentes) de su faz dinámica (teoría de la interpretación jurídica).

This paper intends to throw light, on the one hand, upon Waldron’s theory of legal interpretation and, on the other, upon whether or not there is a relationship between the latter and his normative theory on the sources of law. More specifically, the author wonders whether there is any relationship between the social sources thesis defended by Waldron’s normative positivism (the special dignity/authority thesis of democratic legislation) and his theory of legal interpretation (textualist or integrity thesis?). The lesson that we hope to learn from this analysis is that if one intends to make a normative theory of law, it is not possible to completely separate the static aspect of law (in this case, theory of sources) from its dynamic face (theory of legal interpretation).
