El estándar de libertad de expresión y sus nuevos desafíos

Abstract

Sin lugar a dudas la libertad de expresión es fundamental para el ejercicio de derechos fundamentales, para el desarrollo de las personas y para la existencia de una sociedad libre, democrática y participativa. El impacto de Internet ha modificado nuestras vidas, pues disponemos de un flujo increíble de información que antes no imaginábamos tener a nuestro alcance. Este flujo de información no implica que los ciudadanos estén más informados que antes, ni que con esa información ejerzan necesariamente un mejor control de los actos de gobierno que exige toda democracia. Este trabajo explora, primero, cuestiones generales acerca de la libertad de expresión, y luego examina algunos de los nuevos desafíos que plantea la era digital en esta materia.

Freedom of expression is crucial for the exercise of fundamental rights, the development of people and the existence of a free, participatory and democratic society. The impact of the Internet has changed our lives, as we now have a considerable flow of information that we did not previously have within our reach. This flow of information does not imply that citizens are more informed than before, or that with that information they necessarily exercise a better control of the acts of government that all democracy demands. This paper first explores general questions about freedom of expression, and then examines some of the new challenges posed by the digital age in this area.
