Los dilemas y las ambigüedades en los efectos de la Opinión Consultiva 17

Abstract

Este trabajo examina la eficacia de los argumentos de la Corte Interamericana de Derechos Humanos en la Opinión Consultiva 17, en cuanto a la protección de la infancia y las medidas de protección aplicadas por los Estados. El objetivo es analizar e ilustrar los efectos de la justificación sobre límites estatales con respecto a las medidas de protección, además de determinar de manera clara la función del Estado como garante de derechos para asegurar el bienestar de los niños, niñas y adolescentes en la región. Para ello, se mide el impacto jurisprudencial y el alcance de los temas desarrollados por los jueces en las decisiones posteriores a esta opinión consultiva.

The paper examines the effectiveness of the arguments of the Inter-American Court of Human Rights in the Advisory Opinion 17, regarding the protection of children and the protection measures applied by the States. The objective is to analyze and to illustrate the effects of the justification on state limits with respect to protection measures, and to clearly determine the role of the State as guarantor of rights to ensure the well-being of children in the region. The paper thus assesses the impact of the Advisory Opinion on the case law of the Court and scope of the topics dealt with by judges in subsequent decisions.
