Dignidad humana, gobierno del derecho y razón práctica

Abstract

En el presente artículo se sostienen dos tesis centrales: (i) que la dignidad humana no se funda en las capacidades de conocimiento abstracto y de libre elección, sino que, a la inversa, esas capacidades se fundan en la naturaleza espiritual del hombre, que es la que justifica racionalmente su dignidad; y (ii) que esa dignidad del hombre es la que fundamenta la existencia y valor del rule of law. Todo ello, en debate con varios autores contemporáneos relevantes.

In this article the author defends two main thesis: (i) that human dignity is not founded in the capacities of abstract knowledge and free choice, but in the spiritual nature of man, which is the real basis of human dignity; and (ii) that human dignity is the radical groundwork or foundation of the existence and value of the rule of law. All this, in debate with several and relevant contemporary authors.
